Today, along with my cocounsel from the Disability Law and Advocacy Center of Tennessee, the National Health Law Program, and the Nashville law firm of Brewer, Krause, Brooks, Chastain & Burrow, I filed this brief
for the plaintiffs-appellees in Brown v. Tennessee Department of Finance and Administration
. The case is a class action brought on behalf of Tennessee residents with developmental disabilities who were eligible for but denied enrollment in home-and-community-based waiver programs. The state entered into a consent decree a couple of years back, but now it wants out of the deal. Our brief argues that there's no basis for vacating the decree.
